Terms of Service

These terms are a contract between you and Making Power Moves LLC ("Buffed", "we", "us"). By using buffed.studio, booking an appointment through a Buffed booking page, or operating a studio on Buffed, you agree to them. If you do not agree, do not use the service.

1. What Buffed is

Buffed is software that lets a nail studio publish its services and availability and lets clients book appointments with that studio. Buffed is a booking platform. Buffed does not perform nail services and is not a party to the appointment. The studio is an independent business, solely responsible for the services it provides, its licensing, its pricing, its conduct, and the results of its work.

Two kinds of people use Buffed, and these terms apply to both:

• A client, someone booking an appointment.
• A studio, a business operating a booking page on Buffed under a subscription.

2. Accounts

You must provide accurate information and keep it current. You are responsible for activity under your account and for keeping your login credentials confidential. You must be at least 18, or have permission from a parent or guardian, to book an appointment.

3. Bookings and cancellations

When you book, Buffed holds the time slot briefly while you complete the booking. An unconfirmed hold expires automatically and the slot is released.

A confirmed booking is an appointment with the studio, not with Buffed. Each studio sets its own cancellation, rescheduling, no-show, and late-arrival policies, and those policies govern your appointment. You can manage or cancel an appointment from the link in your confirmation message, subject to the studio's policy.

Studios are responsible for keeping their availability accurate. Buffed does not guarantee that any particular time will remain available, and does not guarantee that a studio will honor a booking.

4. Payments

Payments are processed by Stripe. By paying through Buffed you also agree to Stripe's terms. Buffed does not receive or store your full card number.

For clients. Where a studio takes payment or a deposit through Buffed, the amount, what it covers, and whether it is refundable are set by the studio. Refund requests go to the studio. Buffed can assist but does not control the studio's refund decision.

For studios. Buffed is sold as a subscription. Fees, billing interval, and what each plan includes are shown at the point of purchase. Subscriptions renew automatically until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period, and fees already paid are not refunded except where required by law. We may change pricing with at least 30 days' notice before it applies to your next renewal. Failure to pay may result in suspension of your booking page. You are responsible for your own taxes on the services you sell.

Platform fee on payments (studios). Separately from your subscription, Buffed charges a platform fee on payments processed through Buffed's Stripe integration, for example on booking deposits taken through your Buffed booking page. The fee is a percentage of the payment and is deducted before the money reaches your Stripe account. It is in addition to Stripe's own processing fees, which Stripe charges and sets.

The fee does not apply to your Buffed subscription, and it does not apply to payments you take outside Buffed: cash, your own payment links, or any other method that does not run through Buffed. Your studio's current rate is shown on your billing page in your dashboard. We may change your rate with at least 30 days' notice before it applies.

5. Text messages and email

If you provide a phone number when booking, you consent to receive appointment-related text messages as described in our Privacy Policy. Message frequency varies; message and data rates may apply; reply STOP to opt out, HELP for help. Transactional emails about an appointment you booked are part of the service and are not marketing.

Fair use of automated messaging (studios). Your subscription includes, per studio per month, 200 automated client text messages. This comfortably covers normal use by a single-location studio. If your studio goes over in a given month, we do not interrupt your service -- messaging keeps working, and the amount over your included allowance is billed automatically to your subscription's payment method. We will show you a notice in your dashboard as you approach your allowance, and again if you go over it.

Your studio's assistants (Selena, Chloe, and Ivy). These are included in your subscription for ordinary business use, with no separate usage charge. We will show you a notice in your dashboard if a studio's usage runs unusually high in a month. We may pause automated messaging or a studio's assistants only in cases of clear misuse, such as an automated script sending an abnormal volume of messages or requests -- never simply because your studio had a busy month.

6. Acceptable use

Do not use Buffed to break the law; to book fraudulently or in someone else's name without permission; to harass anyone; to scrape, probe, or overload the service; to attempt to access accounts or data that are not yours; to reverse engineer the service; or to resell or white-label it without our written permission. We may suspend or terminate access for any of these.

Studios are additionally responsible for holding any license required to operate, for the accuracy of what they publish on their booking page, and for their own compliance with health, safety, employment, and consumer protection law.

7. Your content

You keep ownership of what you upload: studio names, service descriptions, photos, notes. You grant us a non-exclusive license to host, display, and transmit it as needed to operate the service. You represent that you have the right to everything you upload.

Buffed, its software, design, and branding remain ours.

8. Availability

We aim to keep Buffed running but do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue features. We may perform maintenance that makes the service temporarily unavailable.

9. Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will meet your requirements, that bookings will be error-free, or that messages will always be delivered, because mobile carriers and email providers are outside our control, and carriers are not liable for delayed or undelivered messages.

We make no warranty about any studio, its licensing, the quality or safety of its services, or any outcome of an appointment.

10. Limitation of liability

To the maximum extent permitted by law, Making Power Moves LLC is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or lost goodwill, arising out of or relating to the service.

Our total liability for any claim relating to the service is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow certain limitations, in which case those limitations apply only to the extent permitted.

11. Indemnity

You agree to indemnify and hold harmless Making Power Moves LLC and its officers and employees from claims, damages, and costs (including reasonable legal fees) arising from your use of the service, your content, your breach of these terms, or, if you are a studio, the services you provide to your clients.

12. Termination

You may stop using Buffed at any time. We may suspend or terminate access if you breach these terms, if required by law, or if continuing would create risk to Buffed or its users. Some sections survive termination by their nature: payment obligations, disclaimers, limitation of liability, indemnity, and governing law.

13. Governing law and disputes

These terms are governed by the laws of the State of Mississippi, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Mississippi, and you consent to their jurisdiction.

14. Changes

We may update these terms. The "Last updated" date will change and material changes will be posted on this page. Continuing to use Buffed after a change means you accept it.
